Terms and Conditions
1. Scope
These Terms apply to all offers, services, trainings, courses, online formats, treatments, appointment reservations, product offers and ancillary services of UNEW Beauty Couture AG. Specific written agreements and specific shop/platform terms prevail where expressly agreed. Mandatory consumer law remains reserved.
2. Contracting parties and customer groups
The contracting party is UNEW Beauty Couture AG, Sinserstrasse 8, 6330 Cham, Switzerland. Offers are addressed to business customers (B2B) and private customers (B2C). B2B provisions apply to persons or entities acting in their commercial, professional or independent activity.
3. Subject matter of the contract
UNEW provides trainings, treatments, consulting and ancillary services and may offer products, starter kits, devices, technical products and professional systems. The confirmed offer, booking confirmation, invoice or service description is decisive.
4. Conclusion of contract
A contract is concluded when UNEW confirms a booking, order, request or assignment. UNEW may reject requests or require additional information, evidence, qualifications or prerequisites, especially for professional products, devices, protected brand systems and trainings.
5. Prices and VAT
All prices are stated in CHF unless otherwise indicated. B2B prices are exclusive of VAT unless stated otherwise. B2C prices include statutory VAT where payable. The price confirmed at contract conclusion is decisive. Errors and changes remain reserved.
6. Payment
Payment is made according to the offered payment methods. Unless otherwise agreed, invoices are payable within 10 days without deduction. UNEW may withhold services, training places, deliveries or appointments until payment. Late payment may trigger interest up to 5% p.a., reminder, collection and enforcement costs.
7. Credit and payment checks
For invoice purchases, advance performance or increased default risk, UNEW may perform credit and payment checks. Payment and contract data may be processed and shared with payment providers, collection agencies, credit information agencies or other required third parties. The Privacy Policy applies.
8. Retention of title
Delivered products, devices, starter kits and other goods remain the property of UNEW Beauty Couture AG until full payment has been received. UNEW may register retention of title where legally provided or appropriate.
9. Delivery, collection and transfer of risk
Delivery dates are non-binding unless confirmed in writing. The customer is responsible for correct delivery information. Risk passes to the customer upon handover to the carrier or, in case of collection, at the agreed collection point. Delays caused by availability, transport, official requirements or force majeure do not automatically create damage claims.
10. Inspection obligation and notice of defects
Goods must be inspected immediately upon receipt. Obvious defects, incorrect deliveries or transport damage must be reported in writing within 5 calendar days. Otherwise goods are deemed accepted to the extent permitted by law. Hidden defects must be reported immediately after discovery.
11. Trainings, education programmes and certificates
Trainings teach skills for beauty, nail, lash, brow, cosmetic and related systems. Prerequisites such as qualifications, age, professional activity or product requirements may apply. Certificates are issued only after full participation and fulfilment of training requirements. No economic, professional, approval, customer or treatment result is guaranteed.
12. Cancellation, rebooking and no-show for trainings
Unless otherwise communicated, cancellations up to 30 days before a training are refunded 100%, up to 15 days 50%, and less than 15 days no refund is owed. No-shows are charged in full. Substitute participants require UNEW’s consent. UNEW may postpone trainings for illness, insufficient participants, trainer absence, delivery issues, official requirements or force majeure.
13. Online trainings and digital content
Online trainings, digital learning content, documents, videos, presentations and scripts may be used only by the registered or authorised person. Access data must not be shared. Reproduction, publication, resale, use for own trainings or making available to third parties requires written consent. Refunds after digital access are excluded where permitted.
14. Appointment reservations, treatments and services
Appointment reservations for treatments, services or individual appointments are binding. Appointments must be cancelled or rescheduled at least 24 hours in advance. Late cancellations and no-shows are charged in full. This is based on Swiss Code of Obligations provisions, especially Art. 394 et seq. and Art. 404 CO, because reserved time and resources cause economic loss. Any waiver is at UNEW’s discretion.
15. No medical services
Treatments, trainings and consultations are not medical services. UNEW does not provide diagnoses or healing promises and does not replace medical advice. Relevant health information, intolerances, allergies and skin reactions must be disclosed before treatment or application.
16. Products, starter kits and professional systems
Products, starter kits, devices and professional systems may be offered in connection with trainings, websites or consulting. Certain products may be restricted to business customers, trained users or qualified professionals. Manufacturer information, instructions, safety notices, ingredients and warnings are decisive.
17. Returns, exchanges and hygiene products
Returns require prior written consent. The customer bears cost and risk of return unless otherwise agreed or mandatory law applies. Opened, used, unsealed, damaged, incomplete or hygiene-sensitive products that are no longer marketable are excluded from return, exchange and refund where permitted. A general withdrawal right exists only where mandatory or expressly granted.
18. Warranty and guarantee
No warranty is given for specific training or application results. For B2B cosmetic products, warranty is excluded to the extent permitted. For B2C cosmetic products, statutory warranty applies, with permitted exclusions for opened products, tolerance, effect, durability and subjective expectations. Electronic devices have 12 months warranty for material and manufacturing defects; wear parts, misuse, insufficient maintenance, external influences, contrary use and unauthorised interventions are excluded. Manufacturer guarantees are governed by manufacturer terms; UNEW gives no independent guarantee unless written.
19. Repairs
Repairs outside warranty are chargeable. If inspection shows no warranty case, inspection, handling, repair and shipping costs may be charged. UNEW may use third parties, service centres or manufacturers and may request approval of costs before repairs.
20. Professional responsibility, application and legal requirements
Users are responsible for correct application of products, devices, techniques and training content. Professional customers must comply with legal, cosmetic, hygiene, labour, safety and professional requirements. Training content does not replace the user’s own review of laws, product information, manufacturer instructions, safety data or labelling duties.
21. Resale and own training activities
Resale of professional products or use of products, brand systems, concepts or training content for own trainings requires written consent from UNEW or the brand owner. Sharing materials, methods, access data or digital content with third parties is prohibited without consent.
22. Copyright and usage rights
All UNEW content, including texts, images, videos, presentations, documents, concepts, brand materials, digital content and website content, is protected. Use, reproduction, publication, editing, sharing or commercial exploitation requires prior written consent.
23. Reviews, comments and testimonials
UNEW may allow reviews, comments, testimonials, photos or other content. Submitted content must be truthful, lawful and free of third-party rights violations. UNEW may review, shorten, not publish or remove content for objective reasons. By submitting content, the customer grants UNEW a non-exclusive worldwide and time-unlimited usage right for offers, websites, social media and marketing where permitted.
24. Liability
UNEW is liable only for intent and gross negligence to the extent permitted by law. Liability for indirect damages, consequential damages, loss of profit, downtime, reputational damage, treatment results, application errors, economic losses or damages from improper application is excluded where permitted. Mandatory liability remains reserved.
25. Force majeure
UNEW is not liable for delays, failures or disruptions caused by events outside its control, including force majeure, illness, accident, trainer absence, official orders, delivery failures, transport problems, technical faults, power outages, pandemics or natural events. Services may be postponed, adapted or reversed if replacement is impossible.
26. Data protection
UNEW processes personal data according to applicable data protection law. The current Privacy Policy applies. By using offers, services, websites, bookings or orders, the customer acknowledges processing for contract handling, communication, service provision, invoicing, administration and legal documentation.
27. Changes to these Terms
UNEW may amend these Terms at any time. The version valid at contract conclusion applies unless compelling reasons require otherwise. For existing contracts, amendments apply only where agreed or legally permissible.
28. Governing law, international customers and place of jurisdiction
Swiss substantive law applies, excluding CISG where applicable. Mandatory consumer protection or data protection rules for EU or other international customers remain reserved where they cannot be waived. For business customers, Zug, Switzerland, is the exclusive place of jurisdiction. Mandatory statutory jurisdictions for private customers remain reserved.
29. Final provisions
If any provision is invalid, incomplete or unenforceable, the remaining provisions remain valid. It is replaced, where permitted, by a provision closest to its economic purpose.
